REFERRAL PROGRAM
1. Carmartz Referral Program (‘Referral Program’) is a reward based referral program for the Members of Carmartz (‘Carmartz’). Under this program, the Members of Carmartz who have an Account and does not fall within the category mentioned in D (1) of the General Terms are eligible to refer a new customer (“New Member”) to Carmartz.
2. The Referral Program is valid from 18th October 2018 to 31st December 2019, which can be discontinued anytime or extended at the sole discretion of Carmartz.
3. The New Member will be contacted by the Carmartz sales team. Upon the successful activation of membership of the New Member, the Member will become eligible to a credit of Rs. 1000/- as Referral Benefits to his/her Carmartz Membership account within one (1) day of such successful activation.
REFERRAL BENEFIT
Subject to terms and conditions of this Referral program, Referral Benefit shall mean an amount of Rs. 1000/- per successful transaction of car buying/selling deal of the New Member.
METHODS OF PARTICIPATION
A Member can refer new Members to Carmartz through following modes:
1. Through SMS: A Subscriber can text: Refer <Mobile Number> Carmartz from his/her RMN (primary/alternate).
  1. In case the Member has other numbers as IDs linked to his/her account: Member will have to indicate the Membership ID on which Member would like to receive the Referral Benefit.
2. GENERAL TERMS AND CONDITIONS
  1. The following persons shall not be entitled to participate in this Referral Program:
    1. Employees and relatives of the employees of Carmartz ;
    2. Carmartz business associates including the dealers and advertising agencies;
    3. Anyone who may be involved with the promotion such as content partners, vendors, agencies etc.;
    4. Members who have already received the benefits of this Referral Program for three (10) times during a week of this Referral Program; and
    5. Residents of any state in India, if it is prohibited by law in such state for example, State of Tamil Nadu.
  2. In addition to the terms and conditions stated here, the Subscribers shall be bound by the terms and conditions stipulated in the Hardware Warranty Terms and Conditions, Specific Terms and Conditions of Carmartz Membership Contract and/or Specific Terms and Conditions of Carmartz Membership Contract for Carmartz products provided on Entrustment basis and/or Everywhere Terms and Conditions and such other documents, all found on the Carmartz website – carmartz.com. The documents referred above will be collectively referred herein as ‘Membership Contract’.
  3. The Referral Program is valid from 18 th October , 2018 until 31st December, 2019, which can be discontinued anytime or extended at the sole discretion of Carmartz .
  4. The Subscriber can refer during this period of offer.
  5. Carmartz reserves the right, at any time, to verify eligibility requirements, in any manner deemed appropriate by Carmartz .
  6. Only a Member of Carmartz having an membership account status can refer new Members under this Referral Program.
  7. An existing Carmartz member (Active/In-active) will not be considered as a new referral.
  8. Only Regular-Residential category members can refer a New Member . Any reference from any Carmartz employee, agent, dealer, installer, company associate etc. will not be considered as reference.
  9. A Member can refer a New Member only by sharing the 10-digit mobile number of the new Member. The member has to do so through his/her RMN (primary or alternate).
  10. The New Member will be informed that he/she has been referred by a Carmartz member (members name will be shared with such New Member).
  11. Any New Member can be referred only once. A second referral of the same New Member will not be accepted as a New member.
  12. Upon the successful transaction through Carmartz of the New member, the member will become eligible to receive a credit of Rs. 1000/- to his/her account one (1) day post activation of Carmartz transaction of the New member.
  13. The said Referral Benefit shall only be a one-time credit and shall not be considered as a recurring monthly credit. Carmartz reserves the right to increase or decrease the amount of the said Referral Benefit anytime during the Term of this Referral Program without any prior intimation to its Members.
  14. A member can refer up to a maximum of hundred (100) new members , however, the member can receive the Referral Benefits to his/her Carmartz Account for only three (3) successful activation of the new members referred by him/her. For avoidance of any doubt, a member will not receive any Referral Benefits any referrals beyond three (3) successful New members activations of the Carmartz transaction referred by him/her.
  15. This Referral Program is non-transferable, not for resale.
  16. A member will be eligible for the Referral Benefit if the New member referred by the member does transaction of vehicle through Carmartz.
  17. The Member having multiple Membership account linked to his/her RMN, can receive the Referral Benefits credit in only one Membership account provided by him/her at the time of referring the New Member.
  18. Carmartz reserves the right at any time, without prior notice, without assigning any reason and without any liability whatsoever, to add or vary all or any of the terms and conditions or to replace, wholly or in part this Referral Program or to withdraw it completely or to change the composition of Referral Program.
  19. All taxes and/or levies applicable in relation to the Referral Program shall be solely borne by the existing Member.
  20. The charges for SMS sent by the Subscriber for the participation in this Referral Program shall be solely borne by the Member as per the rates and charges applicable by the Members respective telecom network provider.
  21. Carmartz reserves the right to reverse Referral Benefit amount mistakenly credited to the Members Carmartz account.
  22. The Member hereby declare that they obtained due consent from the new Member to provide their contact details to Carmartz, and that Carmartz may contact them to offer its products and/or services. The Member shall be responsible to Carmartz, for any losses or claims that may be occasioned upon Carmartz, in the event that this declaration is found to be untrue.
  23. Carmartz will not be responsible for any loss or damage caused to the Members if the Referral Program is cancelled and/or withdrawn by Carmartz or if the Carmartz is not able to Participate in the Referral Program due to a Force Majeure Event including without limitation for reasons beyond the reasonable control of Carmartz such as war, natural calamities, floods, failure of telecommunication network, satellite technology failure etc.
  24. By participating in this Referral Program, it shall be deemed to be construed that the Members have read and consented to the terms and conditions stated here in and in the Carmartz referral Contract.
  25. The Subscribers and/or any person through the Members shall waive any and all right that such an individual may have to claim ambiguity in these terms and conditions and agrees to release, indemnify and hold harmless Carmartz and its respective affiliates, advertising and promotion agencies, and its respective agents, partners, representatives, officers, directors, shareholders and employees from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from the Members participating in this Referral Program.
  26. Carmartz shall not be responsible for printing or typographical errors in any promotional materials; or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, mail system, human or other error; or for electronic, computer, or telephonic malfunction or error, including inability to access the Carmartz website or process any transaction thereon.
  27. All capitalized terms used herein shall have the same meaning as ascribed to them in the Carmartz referral Contract.
  28. In the event of any inconsistency between the Membership referral Contract and these Terms and Conditions, in so far as this Referral Program is concerned, the latter shall prevail.
  29. Headings used herein are for convenience only and do not affect the interpretation of this Referral Program Document.
  30. The Referral Program shall be construed in accordance with the laws of India and the courts of Mumbai shall have the sole and exclusive jurisdiction to adjudicate on any disputes arising from this Referral Program.

ONLINE REFERRAL PROGRAM

Following are specific terms and conditions of the Online Referral Program.

The Online Referral Program is valid from 18th October 2018 to 31st December 2019 , which can be discontinued anytime or extended at the sole discretion of Carmartz.
Upon the successful transaction of the reference of the New Member, the Member will become eligible to a credit of Rs. 1000/- as Referral Benefits to his/her account within one (7) days of such successful transaction.

METHODS OF PARTICIPATION

A Member can refer a new Member to Carmartz through following mode:

Through Carmartz website: A Subscriber can visit carmartz.com/participate in the Referral program.
In case the Member has multiple membership IDs linked to his/her account: Member will have to indicate the Membership ID on which Member would like to receive the Referral Benefit.

SPECIAL TERMS AND CONDITIONS

The Online Referral Program is valid from 18th October , 2018 to 31st December 2019, which can be discontinued anytime or extended at the sole discretion of Carmartz.
The Member can refer a New Subscriber starting from 18th October 2018 at 00:00:00 AM.
The New Member will be informed that he/she has been referred by a Carmartz Member through Email, SMS (members name will be shared with such New Member).
